Terms of Service

Introduction
These Terms of Service govern all web design and development services provided by OpticalDev, based in New Jersey, USA. By purchasing our services or engaging with us, you agree to these terms in full.
Services
OpticalDev provides web design and development services as described in the package selected at the time of purchase (Basic, Ultra, or Custom). The scope, deliverables, and timeline are defined by the chosen package and any written agreement between both parties.
Payment
All payments are processed securely through Stripe. Full payment (or the applicable setup fee for Managed plans) is required before development begins. For Managed plans, the monthly retainer fee is billed on a recurring basis and may be cancelled at any time with reasonable notice.
Refund Policy
No refunds will be issued once development has commenced. If OpticalDev is unable to deliver the agreed scope of work, a full refund will be issued. We encourage all clients to reach out if any concerns arise — we are committed to making things right.
Intellectual Property
Under the Ownership plan, all source code, design assets, and deliverables become the client's sole property upon receipt of full payment. OpticalDev retains no rights to the work after handover.
Under the Managed plan, OpticalDev retains the right to host, maintain, and update the site on the client's behalf for the duration of the engagement. The client may request a full export of their site files at any time.
Client Responsibilities
The client is responsible for providing accurate business information, brand assets (logos, images, copy), and timely feedback throughout the project. Delays caused by late client responses may affect the agreed delivery timeline.
Limitation of Liability
OpticalDev is not liable for downtime, data loss, or disruptions caused by third-party services including Vercel (hosting), Stripe (payments), or Formspree (forms). We are also not liable for any losses arising from client-provided content that infringes third-party rights.
Governing Law
These terms are governed by the laws of the State of New Jersey, USA. Any disputes shall be resolved under the jurisdiction of the courts of New Jersey.
